LEGISLATION
The rules governing the teaching activity of the gliding modalities fall within the legislative scope of entities that practice tourist activities in the aquatic environment and, in a complementary way, not being a simple sporting activity, they lack the respective permissive acts of the Public Administration to your exercise.
The exercise of this activity is defined by Decree-Law No. 108/2009 , of 15 May (republished by Decree-Law No. 186/2015 , of 10 October), a diploma that establishes the conditions of access and of carrying out the activity of tourist entertainment companies and maritime-tourism operators, defining, among others, the need to register the company in the National Tourism Operator (RNAAT) and to sign and maintain valid insurance covering the risks for the health and safety of service recipients or third parties arising from their activity.
Furthermore, as a sporting activity, it must comply with the need to be carried out by duly qualified professionals, namely Sport Coaches, duly accredited by the Portuguese Institute of Sport and Youth (IPDJ) .
The POC's - Coastal Coast Programs (previously designated as Coastal Coast Planning Plans), under the responsibility of the Portuguese Environment Agency (APA) , establish how the coastline should be used, in a perspective of coexistence of different uses and activities, where the prevention of risk and guaranteeing the safety of users is of primary concern.
On issues related to the uses and activities to be developed on the coastline , namely surf teaching, it is now up to the Municipalities (in Mainland Portugal) to establish the rules for its licensing, on beaches classified as bathing water (classification published annually in Portaria issued by the Ministries of Defense and the Environment ).
The National Maritime Authority , through the different Port Authorities , is responsible for defining the rules and licensing procedures for these operators, on the remaining beaches, not classified as bathing waters, in Mainland Portugal, and throughout the territory of the Islands.

Taking into account the diversity of the legal context by which surf schools and surf camps in Portugal are guided, as well as the difficulties communicated by our members and the growing number of inspections, the Portuguese Surf Schools Association prepared the 1st Version of the Legal Surf Teaching Operators Guide . This document is the first result of the association's effort to compile information relevant solely to its members and should serve as a guide to a general understanding of the legal context. The same must be requested to AESP by the members in the Members Area .
